They then began communicating via Facebook and texts from November 17, , and in early December the teacher spent time with Jane at a beach.
She then sent him a text. The following night he arranged for Jane to pick him up from a staff Christmas party and they parked and had an “intimate kiss”. Jane visited the teacher at his home and on January 12 last year he picked her up from a party and they had consensual sex at his house. On January 26 Jane’s parents became aware of the relationship and reported the teacher to the principal.
The tribunal found the teacher did not groom Jane and there was no improper conduct by him while he was her teacher, but said he was unsuitable to teach because of the sexual misconduct. It cancelled his registration for 19 months, from February 14 last year, and ordered him to provide a psychologist’s report before reapplying.
